دور الذكاء الاصطناع ي في إثبات الأدلة الجنائية

Abstract

تتناول هذه الدراسة موضوع استخدام تقنيات الذكاء الاصطناعي في الإثبات الجنائي، من خلال بيان الإطار المفاهيمي والقانوني للذكاء الاصطناعي وتحليل مدى مساهمته في تطوير منظومة الإثبات الجنائي ومواكبة التحديات التي فرضتها الجرائم الحديثة. وتركز المذكرة على إبراز أهمية هذه التقنيات في جمع الأدلة الجنائية وتحليلها، ودورها في تعزيز فعالية العدالة الجنائية وتسريع إجراءات البحث والتحقيق والكشف عن الجرائم، مع تسليط الضوء على الإشكالات القانونية والأخلاقية المرتبطة بحجية الأدلة المستمدة منها ومدى توافقها مع ضمانات المحاكمة العادلة وحقوق الإنسان. وقد قُسِّمت الدراسة إلى فصلين؛ خُصِّص الفصل الأول لدراسة القواعد الموضوعية لتقنيات الذكاء الاصطناعي من خلال بيان مفهومه، وتنظيمه القانوني، والتكييف القانوني له ومدى إمكانية منحه الشخصية القانونية. أما الفصل الثاني فقد تناول القواعد الإجرائية لاستخدام تقنيات الذكاء الاصطناعي في الإثبات الجنائي، من خلال دراسة تطبيقاته المختلفة في مجال الإثبات، وبيان حجية الأدلة الرقمية الناتجة عنه، إضافة إلى تحليل الإشكالات القانونية والعملية التي يثيرها استخدامه أمام الجهات القضائية.

This study examines the use of Artificial Intelligence (AI) technologies in criminal evidence, by analyzing the conceptual and legal framework of AI and its contribution to the development of criminal proof systems in light of modern technological and criminal challenges. The thesis highlights the importance of AI applications in collecting, processing, and analyzing criminal evidence, as well as their role in enhancing the efficiency of criminal justice and facilitating criminal investigations. It also addresses the legal and ethical issues arising from the use of AI-generated evidence, particularly regarding its evidentiary value, admissibility, and compatibility with fair trial guarantees and fundamental rights. The study is divided into two chapters. The first chapter is devoted to the substantive legal framework of Artificial Intelligence, including its concept, legal regulation, legal characterization, and the debate surrounding its legal personality. The second chapter focuses on the procedural aspects of using AI technologies in criminal evidence, examining their practical applications in criminal investigations, the evidentiary value of digital evidence derived from such technologies, and the legal challenges associated with their use before criminal courts. .
