العقد الذكي في مجال الذكاء الاصطناعي

Abstract

يرتكز العقد الذكي على تقنية البلوك تشين التي مكنه من الاستغناء عن الوسيط أو الطرف الثالث وهو ما يصطلح عليه باللامركزية، وتثير هذه العقود بعض المشاكل القانونية عند تطبيقها في الواقع العملي بسبب آلية تنفيذها تلقائيا، ولذلك جاء البحث هادفا إلى عرض مفهوم العقد الذكي ونشأته والوقوف على خصائصه وطبيعته القانونية، مع بيان المشاكل التي يمكن أن تثيرها، و قد انتهينا إلى مجموعة من النتائج لعل اهمها : عدم وجود تعريف موحد للعقد الذكي، الذي يتمتع بخاصية التنفيذ الآلي للشروط التي اتفق عليها الاطراف من خلال برامج الكومبيوتر. في هذا الإطار يمكن أن تشكل هذه العقود إضافة حقيقة وفاعلية لنظرية العقد، تستلزم تدخل تشريعيا يؤطرها، الأمر الذي لا يزال الكثير من المشرعين محجمين عنه…الخ.

An intelligent contract is always based on blockchain technology. which enables it to dispense of any intermediary or Third party, i.e. decentralization. However, these contracts raise some legal problems when applied in practice due to the mechanism of their automatic implementation. Therefore, this research is aimed at presenting the concept of the intelligent contract and its emergence, and to determin its characteristics and legal nature, with regard to the problems that can be raised by such contract, as a result, we concluded a set of arguments, perhaps the most important of which was that there is no unified definition of the intelligent contract that has the feature of automated execution of the terms agreed upon by the parties through computer programs. Hence. In this context, these contracts can constitute a real ant actual addition to the contracts.
