الجرائم الاقتصادية في التشريع الجزائري

Abstract

تعد الجریمة الاقتصادیة من أكبر العوائق التي تعیق النهوض بالاقتصاد الوطني وازدهار ه وذلك لم ا له ا من آثار اقتصادیة وسیاسیة واجتماعیة تهدد كیان المجتمع . ولذا قام المشرع الجزائري منذ فجر الاستقلال إلى یومنا هذا بصفة عامة وفي الفترة الممتدة منذ 1990 إلى غایة یومن ا هذ ا بصفة خاصة وهذا بسن قوانین وتنظیم آلیات تهدف إلى قمع هذه الجرائم تتماشى والتطور الجاري سواء في مجال التكنولوجیا أوفي مجالات الحیاة المتنوعة الأخرى ومن هذه القوانین على سبیل المثال قانون 01-05 المتعلق بمكافحة تبییض الأموال وتمویل الإرهاب والقانون 01-06 المتعلق بمكافحة الفساد وغیرها من القوانین الأخرى . وعلى هذا الأساس قمنا بمناقشة هذه الآلیات التي وضعها المشرع الجزائري لمكافحة الجریمة الاقتصادیة ولكون الجرائم الاقتصادیة كثیرة ومتنوعة انصبت دراستن ا على الطبیعة القانونیة للجریمة الاقتصادیة وبعض صوره ا ومن أجل محاربة هذه الجرائم تطرقنا إلى الآلیات المالية في محاربة هذ ه الجریمة بالإضافة إلى الآلیات القضائية ممثلة في الدعوى العمومیة كآلیة قضائیة لمحاربة هذه الجرائم . وكذ ا الهيئات الرقابية لمكافحة هذه الجرائم.

Economic crime is one of the biggest obstacles that hinder the revival and prosperity of the national economy due to its economic, political, and social impacts that threaten the existence of society. Therefore, the Algerian legislator has been working since the dawn of independence until today to address this issue in general, and specifically during the period from 1990 until today, through laws and regulations aimed at combating these crimes in line with contemporary developments, whether in the field of technology or in other diverse life sectors. Among these laws, for example, is Law 01-05 related to combating money laundering and financing terrorism, and Law 01-06 related to combating corruption and other laws. On this basis, we have discussed these mechanisms established by the Algerian legislator to combat economic crime, and given the prevalence and variety of economic crimes, our study focused on the legal nature of economic crime and some of its forms. To combat these crimes, we addressed financial mechanisms in fighting this crime, in addition to judicial mechanisms represented in public lawsuits as a judicial means to combat these crimes, as well as the regulatory bodies to combat these crimes.
