إن الرقابة القضائية على الصفقات العمومية توضح لنا مدى حرص المشرع الجزائري على حماية الصفقات العمومية من خلال دور كل من القضاء الإداري الذي يهدف إلى احترام مبدأ المشروعية سواء عن طريق قضاء الإلغاء ، قضاء الاستعجال أو القضاء الكامل تحقيقا للمصلحة العامة ، فهو صاحب الاختصاص الأصيل في منازعات الصفقات العمومية . أما بالنسبة لرقابة القضاء الجزائي يتمثل في دراسة أ ركان الجرائم و العقوبات المقررة لها، فيمارس دوره الرقابي على مبدأ الشرعية لتفاقم ظاهرة الفساد و تهدف للحفاظ على المال العام و مكافحة الجرائم.
