حدود الرقابة القضائبة على الحكم التحكيمي التجاري الدولي

Abstract

أمام هذا التصادم الواضح و الجلي بين النظامين و من خلال ما تمّ التوصل إليه، فالقضاء العادي من خلال الرقابة القضائية يرى أن له تدخل مساعد و مكمل و لاحق و حماية و ضمانة قانونية للحقوق و التحكيم الذي يقوم على إتفاق الأطراف، يرى أن تدخله مقيد و معرقل من خلال إرجاع الأطراف عنوة إلى القضاء العادي و هو ما يتعارض مع المبدأ الجوهري و هو مبدأ سلطان الإرادة و بالتالي فهذا النوع من الرقابة غير المرغوب فيه بالنسبة لأحكام المحكمين لأنها تتنافى مع طبيعة التحكيم و ممارستها، من شأنه أن يؤدي إلى عدم التشجيع على اللجوء إلى التحكيم التجاري الدولي و يفقد الثقة بنظام التحكيم. Abstract The regard to this clear confrontation between the two systems, and through what we have achieved, it appears that the ordinary judicial system, through judicial control, considers its intervention auxiliary and complementary, with support, protection and regulatory guarantee to rights. In contrast, the arbitration that is built on the agreement of the parties considers that the intervention of the ordinary judicial system is obstructive and restrictive through the obligation of the parties to resort again to the ordinary judicial system, which is in contradiction with the fundamental principle which is that of the administration sovereignty; ultimately, this kind of control is undesirable for the arbitrators' decisions because it contradicts the nature of the arbitration and its practices, and the use of this control discourages the use of international commercial arbitration and risks discrediting the arbitration system
