التنظيم القانوني لمفتشية العمل في التشريع الجزائري

Abstract

تشكل مفتشية العمل أحد أهم الآليات القانونية، التي اعتمد عليها المشرع الجزائري، لضمان احترام التشريع وتنظيم علاقات العمل، داخل مختلف القطاعات، تتوزع مفتشية العمل بين هياكل مركزية تعنى بالتوجيه والتنسيق، وهياكل لامركزية تضطلع بمهام التفتيش، الميداني على المستوى الجهوي والولائي. يعد هذا التنظيم من بين الضمانات لحماية حقوق العمال، ومراقبة مدى التزام المستخدمين بتشريعات العمل. تشمل مهام مفتشية العمل مراقبة ظروف العمل داخل المؤسسات، متابعة تنفيذ الاتفاقات الجماعية، وكذا التدخل في تسوية النزاعات الفردية عن طريق المصالحة، والجماعية عبر آليات الوساطة والتوفيق وكذا التحكيم.

The labour inspectorate, is considered one of the key legal mechanisms relied, upon by the Algerian legislator to ensure compliance, with social legislator and the proper regulation of lebour relations, across all sectors. It operates through central structures responsible, for guidance and coordination, as well as, decentralized bodies tasked with field inspections, at the regional and local levels, this organizational frame work plays a vital role, in safe guarding worker’s social rights and monitoring employer’s adherence to lebourlaw’s. It’s main responsibilities include, overseeing working conditions within companies, ensuring the enforcement of collective agreements, and intervening in the resolution of individual disputes, through conciliation, as well as, collective disputes through mediation and reconciliation procedures.
