دور الشفافية الإدارية في مكافحة الفساد

Abstract

تتناول هذه الدراسة موضوع دور الشفافية الإدارية في مكافحة الفساد، من خلال مقاربة شاملة تجمع بين الأسس المفاهيمية، النظرية، والتشريعية، فضلا عن تحليل الآليات والتجارب العملية والدولية. فقد عالجت الدراسة في شقها الأول الإطار المفاهيمي للشفافية الإدارية، حيث تم تحديد مفهومها وتعريفها لغويا، اصطلاحيا، وقانونيا. كما بينت أهميتها، مبادئها، وأنواعها، مع التطرق إلى التكيف القانوني لها، وعلاقتها بالحوكمةالرشيدة. بالإضافة لذلك، تناول هذا الشق الأساس القانوني للشفافية الإدارية من حيث المرتكزات الدستورية والتشريعية، آليات تكريسها في القوانين الوطنية والدولية، الاتفاقيات (العربية والإقليمية)، المعايير الدولية (منظمة الشفافية الدولية، البنك الدولي)، إضافة إلى مؤشر مدركات الفساد. أما في شقها الثاني، فقد ركزت الدراسة على آليات تكريس الشفافية الإدارية ودورها في مكافحة الفساد باستعرض الآليات القانونية والمؤسساتية التي ترسخ هذا المبدأ، حق الحصول على المعلومات والوثائق الإداريةوآليات نشر القرارات والأعمال الإدارية، إلى جانب تمكين المجتمع المدني والإعلام من مراقبة الإدارة وتكريس المساءلة. كما تناولت المذكرة أهمية الشفافية في العملية الإدارية من حيث تطبيق مبادئ النزاهة والعدالة، منع تعارض المصالح، وتطوير المرفق العام. علاوة على ذلك، تم تحليل دور الشفافية في مكافحة الفساد عبر تعزيز بيئة النزاهة والوقاية منه، مبرزةدور المجالس المنتخبة، المجتمع المدني، ووسائل الإعلام، وصولا إلى آفاق تطوير الشفافية الإدارية للحد من الفساد عبر الحوكمة الإلكترونية والرقمنة الذكية. وتخلص الدراسة إلى أن الشفافية الإدارية ليست مجرد مبدأ تنظيمي، بل هي ركيزة أساسية لتحقيق الحكم الرشيد، مكافحة الفساد، تعزيز الثقة بين الإدارة والمجتمع، وتحقيق العدالة والمساءلة في إدارة الشأن العام. This study addresses the role of administrative transparency in combating corruption through a comprehensive approach. It combines conceptual, theoretical, and legislative foundations, alongside an analysis of practical and international mechanisms and experiences. In its first part, the study examines the conceptual framework of administrative transparency, defining its linguistic, idiomatic, and legal concepts. It highlights its significance, principles, and types, while exploring its legal characterization and relationship with good governance. Additionally, this section addresses the legal foundation of administrative transparency in terms of constitutional and legislative pillars, the mechanisms for enshrining it in national and international laws, international conventions (Arab and regional), and international standards (Transparency International, the World Bank), in addition to the Corruption Perceptions Index. In its second part, the study focuses on the mechanisms for establishing administrative transparency and its role in combating corruption. It reviews the legal and institutional mechanisms that reinforce this principle, the right to access administrative information and documents, and the mechanisms for publishing administrative decisions and acts. It also covers empowering civil society and the media to monitor the administration and institutionalize accountability. Furthermore, the thesis explores the importance of transparency in the administrative process regarding the application of the principles of integrity and justice, the prevention of conflicts of interest, and the development of public utilities. Moreover, it analyzes the role of transparency in combating corruption by fostering an environment of integrity and prevention, highlighting the roles of elected councils, civil society, and the media. Finally, it outlines the prospects for developing administrative transparency to curb corruption through e-governance and smart digitization. The study concludes that administrative transparency is not merely an organizational principle; rather, it is a fundamental pillar for achieving good governance, combating corruption, enhancing trust between the administration and society, and ensuring justice and accountability in the management of public affairs.
