سلطة الضبط في الظروف الاستثنائية

Abstract

تناولنا في هذه الدراسة حدود سلطة الضبط في الظروف الاستثنائية، وبما أن هذه الظروف المؤقتة تمر بها الدولة في مرحلة ما، بحيث يتم تطبيق قوانين استثنائية مؤقتة بدلا ا من القوانين العادية التي تتميز بعدم المش ر وعية، حسب تكيفها مع الحالات الاستثنائية، ولكون الضبط الإداري له دور مهم في الحفاظ على النظام العام أثناء هذه الظروف الاستثنائية، وذلك بمنحها المشرع صلاحيات واسعة ،فانه قد قيدها بعدد من القيود الشكلية والموضوعية خوفا من ضياع الحقوق والحريات العامة، بل تجاوز ذلك بفرض الرقابة على القرارات المتخذة في الظروف الاستثنائية سواء كانت رقابة تشريعية أو قضائية أو حكومية أو غير حكومية، قصد الحفاظ على مبدأ المش ر وعية وعدم مخالفة الدستور.

In this study, we dealt with the limits of the authority to control in exceptional circumstances, and since these temporary circumstances are experienced by the state at some stage, so that temporary exceptional laws are applied instead of ordinary laws that are characterized by the nature of illegality. According to its adaptation to exceptional cases, and the fact that administrative control plays an important role in maintaining public order during these exceptional circumstances, by granting it wide powers, the legislator has restricted it with a number of formal and objective restrictions for fear of losing public rights and freedoms, and even exceeded that by imposing control over decisions taken in Exceptional circumstances, whether legislative, judicial, governmental or non-governmental oversight, in order to preserve the principle of legality and not violate the constitution.
